Damn I'm pissed. I can't believe the other guy's insurance, Geico, has the gall to file a claim against my insurance. And my insurance co said in MD even if you're 1% at fault then you can't collect from the other person's insurance. Anyone know if that's true?

 

So, isn't the other guy at least 1% at fault, too? Why does HIS insurance get to collect, and not yours? Sounds like your insurance is bending you over... Bet his insurance is selling the same kool-aid, to him.

 

No, it just means neither of us gets to collect from each others' insurance. I'm fuming now, I just found out the other driver simply received an "improper turn at intersection" ticket. 40 bucks cheaper than mine. What about reckless driving, failure to yield to traffic, or even failure to control vehicle speed to avoid collision? Unbelievable. Where the hell is the justice for F's sake?

 

I thought "No-fault" insurance states are where each insurance company pays for they own vehicles, regardless of who is at fault.

 

MD isn't no-fault. But their stupid negligence law is called contributory negligence rather than comparative negligence. Even if you're 1% at fault you aren't allowed to sue for compensation from the other party. Ridiculous 200 yr old common law from the Brits. Only 4 states and DC still follow this unfair crap. Every other state, the federal government, and U.S. territories use comparative negligence. That is if you're 5% at fault then you get 95% compensation.

 

I don't even care about the negligence law since I should be 0% at fault. I just can't believe the officer thought I was more at fault then the other guy. From now on if I'm in an accident, I'll be damn sure to be the one who caused it, that way I'll be held less responsible. FFS. DAMN.

 

At least, the one silver lining to all of this is that you and your family walked away form the accident...

 

Yes, at the end that is really what matters the most. I don't know what I would have done if something happened to my kids or wife. Life is unfair and I just need to let it go and move on.
