Default I Got a speeding ticket (long)

quick highlight from the so-cal GTG this month...
any ideas / advise on how to fight it would be greatly appreciated


[&o] yes i3uddha got a ticket...


how can this be u ask? he's always last, always getting lost etc. etc.
well, this time I was determined to not just cruise over to the rendevouz...
and after being passed by a few audis on the 5, (through some very fancy lane changes)


the first opportunity I had i downshifted & gunned it on an open stretch...
heres what i saw :






then the conversation went a lil like this:


CHP: "Well, obviously i dont have to tell u why i pulled u over, u were driving waaay too fast.
licence registration etc. etc. "

i3uddha: "u see officer, Im not from around here [&o] I'm following my car club,
& I didnt want to get left behind bec.
I wasnt sure exactly were the meeting point was
(doh! hide garmin gps[:'(]).
I wasnt paying attentionat all too how fast I was going...I really had no idea"


CHP: well, I dropped ur speed down on this. (hands over ticket) [:@]
I was going well over a hundred just to catch up to you from the carpool lane...
I marked u at 103 mph even though u were well beyond that





i3uddha: u realise i didnt have to pull over... I coulda just kept my turbos spooling
& left u behind...





no but seriously... he was pretty cool.. (even commented that I had a nice car..
& I knew how to drive it, even at that speed..) its just the "old ladies"
you scare the crap out of etc. etc. lecture...

anywhooo. I'll be asking for extensions till i figure the best way out of this.
I've got no prior speeding tickets etc. etc...

lesson learned. [&o]


at least I had a blast on the canyon run & at the poker game...
now.. to break the news to wifey about the ticket [:@] [:'(]

lol so that explains ur new sig. best advice, get a lawyer. mines gotten me out of about 10-15 tickets. some of which were 100+ mph. ya i know i drive fast and call me an ******* if u want. you end up paying a little over 100 bux (at least in FL) which is a lot less than the ticket would be. dont try and fight it yourself. those are hard to win. if the lawyer cant get the charges dropped he can def. get you out of the points and the ticket goes away, you just end up paying the fine. this happens to be my area of expertise[8D]

This NOT legal advice; I am just giving you some information...

The NEXT time you get a speeding ticket, do NOT post an (at least implied) admission of guilt online, i.e.:

"the first opportunity I had i downshifted & gunned it on an open stretch..."

GENERAL INFORMATION

If you are ticketed at >25mph over the speed limit in Orange County, traffic school is NOT an option, at least according to the Superior Court's website.

Usually, if one is ticketed, there are 3 options:

1. pay <or> 2. pay and go to traffic school <or> 3. contest the ticket.

There are two methods to contest a ticket - trial by written declaration (in writing) or appear (in court).

The first method involve submitting a written statement to the court explaining / arguing WHY one is NOT guilty of the violation charged. Note that if the speed limit is 65mph, and one is ticketed at 75mph, arguing that one was "only" going at 72mph still means that one IS guilty of the violation charged, if it is under the general speeding statute.

The policeman has a certain period within which to respond to the submission. If they do not respond within that time period, the charges are dropped. From my personal experience and from talking to others who have contested tickets in writing, that happens maybe about 50% of the time.

There is some speculation re: policeman being paid overtime to appear in court as witnesses, but not for doing paperwork, e.g., responding to trial by written declaration statements. See www.ticketassassin.com

Thus, the first way (in writing) is preferable because even if one loses, the second way is still available, via a request for a trial de novo.

I don't know about Florida, but in California, I don't know of any attorney who would take any case for $100.

and just think, if you could get a small donation from a large number of people, you'ld have it taken care of!

I was thinking as i was driving to work today - Im toooooo F'ing old
to be getting stupid tickets like this ...[:'(] I've never had a speeding ticket either...[:@]

I wouldnt be able to hold my head up around here if I took donations....
but seriously, its a great feeling to know that there are ppl even willing to suggest

If one can afford an Audi, one can probably afford the ticket, although a 103mph ticket is going to be $$$. The crappy thing is the increase in insurance over the next five or how ever many years that insurance company tracks tickets.

Sorry to hear about your incident. I would definitely get a lawyer and always fight traffic violations. Usually the ticket will be reduced in some way.

Man thats sucks, know how it feels, I got a court date on the 20th for a HOV violation. I think its time to invest in a V1.
