Any attornies here? Need some advice. CA
Ok, so I expect to be flamed for my "morally questionable" acts, but I got myself into a little trouble. I realize I was in the wrong, and now I want to know if anybody knows what I have to look forward to.
I misused a handicapped placard at my university, got caught. There is a shortage of around (1,300 parking spots) and an abundance of around 700 handicapped spots. I know, still wrong and I'm sorry. Tried to make my midterm on time.
Ok so I'm convicted of a misdemeanor. The law states UP TO $3,500 fine and/or six months in jail. Obviously (at least I hope) that I won't be paying much as this is my very first offense, and the placard was not reported lost or stolen. (In Mom's name.) I go to court on the 28th, and I'm curious to know if anybody knows what kind of fines and punishment to expect. I can't really afford a misdemeanor on my record, is there a way to get it wiped off my record? Will I be put on probation? Would it be wise to hire a public defender (or would it not make too much of a difference in this scenario?) Any help would be greatly appreciated.

Advice - be apologetic, don't in any way justfy the illegal use - explain why you used it (hopefully it was the one time offense), admit your guilt and accept the consequences of your actions.
I'm no lawyer, but having been to court a few times - though never for something of this nature - twice on a jury and a few small claims court issues - I can safely say this.
They most likely will wave the jail time - but you will get a fine - if you are lucky it will be 25% of the $3500 - or 50%.
But be prepared to pay the total amount - truly depends on the judge's mood at the time - don't argue with the judge or he could impose the jail time after all.
You can hire an attorney - but the cost will most likely add another $500 - $1000 to your woes. But it's your call. Best of luck.
