Sorry to brake it to you, but yes it's part of the inspection. I work at a shop in Yorktown, NY and when we do inspection we check the brakes, tires, windshield, headlights, brake lights, corner lights and horn. That's part of the safety check, and then we plug it to the NYVIP program which checks emissions.

ya i will, eion was there and said he didn't know. i don't want another failed inspection on my record lol. the switch is 40 bux from autozone but i don't want to have to spend that freaking money lol

Sup hiword, I just got your PM, yes you will pass. I thought you had a brake light pending code and the brake light didn't work, if it does, it's a bug in vag-com. The online manual states this, according to Section 2.7 of Appendix B:
"2.7 Are there any Fault-Codes that can and should be ignored?
Yes. Most 1995 and earlier Bosch ECU's will show you a DTC 00513 - Engine Speed Sensor (G28) if you scan them when the engine is not running. This fault code goes away by itself once you start the engine. If this sensor were truly defective, the engine would not run at all! Please ignore this code.
In addition, many Automatic Transmission Control Modules will show a DTC 00526 or 17087 that indicates a faulty brake light switch. This can also be ignored and will not appear if you press the brakes once before checking for Fault Codes."
My dad has this code on his A6, and yes it does not show up if the brake is pressed once before the code is checked.

LOL...I think you'll be good. The obd2 inspection only checks for emissions, the safety checks are up to the shop and the person conducting the inspection, plus it's a pending code so as long as your check engine light is off, it will pass.
