Default passing emissions with an engine light on?

Soo....I have an P1423 code. From reading around, it sounds like vacuum leaks are the main cause of this. I have changed all the vacuum lines that I can get to, and still it comes back after I clear it. The car runs fine otherwise, and Im really doubting that its hurting anything. My inspection has been out for a month now, and Im kinda tired of living in this cop-heavy town always looking out for the motor cops hiding in the bushes. Do check engine lights automatically make you fail emissions, or do you only fail when its emissions related??

*corrected, P1423, not 01423.

Take out the bulb and clear the code before you pull in to emissions.

A check engine light is an automatic fail.
Depending on which state you are in you are only allowed 1-2 static fault codes stored in the ECM, if there is a fault thats causing a check engine light it will be another automatic fail.

that doesnt work, because after you clear the code the ECM is in a "not-ready" state and the emissions test will be inconclusive, which is an automatic fail. Once the ECM is done with its checks, the light comes back on. With or without the CEL in, the emissions test can still read the codes. So I guess I will just keep looking for vacuum leaks...

I have had the CEL come on every 2 weeks since October 2008.
I also have a Secondary Air Injection CEL. I reset the light and
passed inspection. It's worth trying.

I did try that already. I have a scanner so I cleared it, and the test came back inconclusive. The guy there asked me if I had reset the CEL and said that was why. He said to come back once it was done with its checks. But by then, the CEL was back on. Texas kinda sucks sometimes. The fines are way to big for shops to pull favors around here.
