only problem with that attitude is when you tell the insurance and make the claim ( the insurance will go up because they will log it ) regardless of if its a no fault accident they willregard you as having a history and you first involvement in an accident is the start of your history, I know because that happened to me

That's why you talk to the agent first to confirm all this, before making any claims. It's not necessarily true that your rates will go up if you are not at fault; I've had it work that way. It may also depend on state insurance regulations (I'm in California), but it's certainly worth a try. Taking Jose to court sounds like the beginning of a very bad experience.

Exactly.

I triedcalling to talk to them,I gave no personal info.

They WILL NOT give me any info without making a claim.
And they won't tell me anything about my premium until after the claim is complete and resolved.

They were completely stubborn about making any concrete statements. They wouldn't even answer when I said "i'm not going to hold you to this because it might not apply to me, but what is normal procedure if I am found not at fault"

Why is everyone so shady?
I understand accountablilty is a pain, but I clearly was excluding them from liablilty when asking the question.

im not sure how the insurance works in the USA but the agent here has to inform the insurer its their legal duty ( they are one of the same ) and part of a group, I hope its not the same there

You need to file a claim, if you dont you'll get fucked.

Your in NYC. - **** like this will get forgotten and brushed back and you'll NEVER find the guy and get your money.


Either he pays for it in full up front in CASH. or you file a claim.

Dont accept half at all, if its his fault he needs to pay for ALL of it. - If he wouldn't have hit you then you wouldn't be in this situation would you? - Your rates will not go up if it is his fault.

Do what you want man, but I would have called my agent right away. - **** screwing up your car man, just think what happens if its fixed in correctly, then you have a junk TT and a huge bill


Go after him with your insurrance company, your in the right, unless you cut him off or something.

Does he even HAVE insurrance? - Most people who dont have it, or have bad histories dont want to file claims.

There's a difference between calling the 800 nationwide claims number and your agent. Call your agent first; they know the system and can advise you; the 800# person is a monkey trained to lead you down one path. And don't even bother with the other guy's insurance; they don't know you, you don't have a policy ith them, etc. You're making this much more complicated than it needs to be.
