I was driving on saturday and I stopped at a traffic light, some a$$hole in a 1988 suburban hit my car just in front of the rear wheel on the driver side.
This guy is a moron. I had to get out of my car to knock on his window and tell him he was on top of my car... He had no clue he even hit me!
I called the police, they came and said since they weren't there they couldn't file a report. So now i'm stuck as to whether I should claim it or not. He offered half of the repair bill if I didn't claim it. I want to claim it because it was his fault... 1000%.
I'm scared they will raise my premiums though because there is no report. This happened in NY, i'm registered in PA, He is registered in NJ.
If I file a claim through his company is it likely they will try to call it no fault or pull some ****? I don't want to pay a $500 deductible, and have my rates raised if it winds up going through my company instead. What is likely to happen?

Thanks for the help. I'm too bummed out to take pics of it or i'd share. It's not too bad, $900 estimate to fix (Good shop, full panel repaint, no tape and spray crap).

Sue the guy... i know it sounds bad but if the guy is sayin he'll only pay for half sue him...

but then again i hate that word, cause of the people who sue for no reason, like cause there kids fat off of mcdonalds... but you have a reason

 

1) - dont settle.
2) - File a claim
3) - Sue his *** for not only the repair bill. - Also consider loss of wages, your personal time, and mental stress.



We're you hit in a parking lot? - On the street? If you were on the street the POLICE have to file a report. - Its bullshit if they didn't, if you call your insurrance company tell them what happened. ...remember the intersections..etc - Those details will throw fault in the proper direction.

Give a few thousand self-absorbed a**holes a weapon that they don't realize is a weapon... things likeme breaking your umbrella because you weren't paying attention and hit me with itare bound to happen.

Glad to hear you didn't get hurt in the accident! Things could of been much worse!!
About your car, well, think about it... $900 half is $450 which is less than your insurance deductible.
Plus your rates won't increase and you car gets fixed. Sounds like a win-win situation to me.
Maybe you could include a rental car in your estimate. I don't see a reason why he shouldn't help pay for that as well!

For once I don't care about the principle. Normally I'd fight to the bitter end over damage to my car, but I'll be kicking myself in the *** everytime I make an insurance payment. I'll pay the full $900 before I have my premiums raised $100 a month for the next 3 years.

Is there any way they can just brush me aside and try to say it was no fault?

 

its a rear ender so he is at fault so take him for 100% repair ( half repair bill heheheheh ) what a joker just as well it was my car he would have been hanging from his roof bars

 

I should have mentioned, Ireally want to avoid doing business with this guy. I think his "half" means he "knows a guy" who will "fix it" for me for cheap. His name is Jose and he drives a 4 color suburban, I don't trust his choice of repair shops.


Outtie, it sounds like the logical choice on paper, but the more I look at it it feels shady. I should have given the info in this post before as background.

OK, you have insurance, sojust call your insurance agent and talk it over; that's what they're there for, right? If it's not your fault then your premiums shouldn't go up, but your insurance guys can tell you that. Let the insurance company deal with it; that's what you're paying for. Don't screw around with this guy directly; you're only headed for trouble if you do, and forget the court thing.
